Trace a deposition excerpt to its transcript and errata

For litigation staff checking quotations from depositions.

How should I use a deposition quotation when a correction sheet exists?

Keep the certified transcript, the correction sheet and the excerpt linked. Read the full question and answer, confirm the page and lines in the correct volume, and flag any change or context that affects the proposed use.

Identify the record behind the quotation

Record the witness, deposition date, volume or session, reporter and certification status. Label working copies clearly. A rough transcript or an automated transcript may paginate differently from the certified record. Preserve each version and label the one used for the excerpt.

Check the actual transcript page and printed line numbers. A PDF viewer’s page count can differ from the printed transcript. Include the question that sets the time period, the answer and any qualification just above or below it. Keep a reference to the exhibit if an answer uses words such as “this one.”

Handle corrections separately

For federal civil depositions, Rule 30(e) addresses review requested by the deponent or a party before the deposition ends. It allows the deponent 30 days from the officer’s notice of availability to review and, for changes in form or substance, sign a statement listing the changes and reasons. The officer records whether review was requested and attaches timely changes.

Retain the notice, original wording, listed change, reason, signature and date. Escalate a disputed or substantive change for legal review under the applicable court’s authority. Preserve the original answer and the correction side by side so a reviewer can assess the difference.

Make the excerpt reproducible

Include the page-line range, original question and answer, correction entry if any, and the sentence where the excerpt will be used. Have a second reader use that information to locate both versions. Check the surrounding page for a later clarification before clearing the quotation.

Worked example

Illustrative example. At page 48, lines 7–10, a witness says “the east gate.” A signed correction says “west gate” and gives the reason that the witness reversed the gate names. A proposed summary saying the witness “consistently identified the west gate” misses the original answer. Cite both records and let counsel decide the proper use.
